Maine AG Frey Says Shadow Hearing Prompting Scrutiny of Biddeford Immigrant Shooting

Maine Attorney General Aaron Frey says the Shadow Hearing on deadly force by ICE in the death of Johan Sebastián Guerrero is prompting his continued investigation into the killing.

The shadow hearing was held Monday in Biddeford by Congresswoman Chellie Pingree and other Democratic members of Congress.

Frey says his office is collecting evidence to determine whether Maine law authorizes legal action to address the conduct.

He also says the Maine Deadly Force Review Panel will make recommendations to minimize the use of deadly force, but has no jurisdiction over the practices of federal agencies.

Sebastián Guerrero was shot and killed by an ICE agent last month in Biddeford in an incident in which he was not the target of an investigation.

Frey says his office is making an effort to be transparent, but protecting the integrity of the investigation takes priority while evidence is still being gathered.

He says they’re assessing whether updates can be made available without interfering with the investigation and will make information available when appropriate.

Sebastián Guerrero’s legal status has been a matter of dispute between ICE, which referred to him as an “illegal alien.” while his immigration status has not been independently confirmed. Immigration court records showed he did not have a final removal order, and was scheduled for an immigration hearing in May.

He was killed on July 13.
